On January 25, 2012, Shree Venkatesh Films (SVF) had agreed with Late Sunil Gangopadhyay in respect of securing exclusive rights in his literary works under the name of  Kakababu Series. As a result, SVF became entitled to create and produce audio visual works such as cinematographic films based on such literary works in Bengali. Having obtained these privileges, SVF produced Mishawr Rawhosyo starting Prosenjit Chatterjee and Directed by Srijit Mukherji, that was released during October, 2013, after which SVF began work on another film by the name of Paharchuray Aatonko. Considerable efforts and expenditure were invested by SVF in production of the said films.

During January, 2015, an article was published in a reputed regional daily, that spoke about production of a film based on Jongolgorer Chabi – a story authored by Sh. Gangopadhyay and part of Kakababu Series. Being aware of its rights in this regard, SVF commenced suitable legal action against the heirs of Sh. Gangopadhyay and M/s R P Tech Vision company headed by Shri Kausatv Roy, the entity undertaking the production of this film, for restraining them from making or producing the said film, among other related reliefs.

The Calcutta High Court heard the matter during March, 2015 and passed the requisite injunction to restraint the defendants from release of the film in question without an express sanction of the Court. Subsequently, in the month of November, 2016, the Honb’le Court heard the matter for final arguments and directed the defendants not to interfere with SVF’s exclusive rights with respect to Kakababu series for the period these rights were exclusively assigned to SVF,  in any manner whatsoever.

The order marks a significant victory for vitality of such exclusive rights agreements and the message is loud and clear in that regard.
